The newly issued Decree 24/2013/ND-CP has a number of adjustments in the marriage procedure that has foreign elements in Vietnam as follows:
For marriage dossier:
– Remove the provisions on the requirement of notarization and legalization of household registration and identity proof.
– Add some cases that must supplement the dossier: divorced in foreign country, Vietnamese resident that has foreign nationality.
The marriage registration procedure is adjusted as follows:
– Spouse could submit the dossier.
– Standby time to interview is reduced to within 15 days and the marriage certificate will be issued after the interview within 05 working days.
– Remove the regulation that the marriage must be listed at the office of the Department of Justice.
– Where in good causes, the date of marriage ceremony may be extended (maximum 90 days).
Decree takes effect from May 15th 2013, replacing Decree 68/2002/ND-CP and Decree 69/2006/ND-CP.
ANT LawyersNghị định 24/2013/NĐ-CP đã có một số điều chỉnh về thủ tục đăng ký kết hôn có yếu tố nước ngoài tại Việt Nam như sau:
Đối với hồ sơ đăng ký kết hôn:
– Bỏ quy định phải công chứng, chứng thực bản sao sổ hộ khẩu và giấy tờ chứng minh về nhân thân.
– Thêm một số trường hợp phải bổ sung hồ sơ: đã ly hôn tại nước ngoài; công dân VN đồng thời có quốc tịch nước ngoài…
Thủ tục đăng ký kết hôn được điều chỉnh như sau:
– Chỉ cần một bên đi nộp hồ sơ.
– Thời gian chờ phỏng vấn giảm xuống còn chậm nhất là 15 ngày, và sẽ được cấp Giấy chứng nhận kết hôn sau khi phỏng vấn chậm nhất 05 ngày làm việc.
– Bỏ quy định phải niêm yết việc kết hôn tại trụ sở Sở tư pháp.
– Trường hợp có lý do chính đáng thì có thể gia hạn ngày tổ chức lễ đăng ký kết hôn (tối đa 90 ngày).
Nghị định có hiệu lực từ ngày 15/05/2013 và thay thế cho các Nghị định 68/2002/NĐ-CP, 69/2006/NĐ-CP.
